To obtain a Financial Services Provider (FSP) license in South Africa, you must apply to the Financial Sector Conduct Authority (FSCA) by meeting specific fit and proper requirements, appointing qualified Key Individuals and a registered Compliance Officer, and submitting your application through the FSCA FAIS eLicensing System.
The entire authorization process typically takes between 6 to 12 months.
Core Requirements
- Legal Entity Setup: Register a formal business structure (company or sole proprietor) with local South African operational address and a bank account. Company registration requires at least one local director.
- Key Individuals (KIs): Appoint at least one local Key Individual who manages and oversees the financial services. KIs must pass the relevant Regulatory Examinations (RE1) and meet honesty, integrity and experience standards.
- Compliance Officer: Appoint an FSCA approved compliance officer to monitor regulatory adherence.
- Financial Soundness: Demonstrate sufficient operational ability, capital adequacy, and solvency in line with FSCA norms.
Application Process
- Determine Category: Select the appropriate FSP category (e.g. Category I for general advice/intermediary work, or Category II for discretionary investment) matching your products sub-categories.
- Compile Documents: Gather company founding papers, notarized IDs, passports, CVs, criminal record checks, proof of qualifications, business plans, business financial projections, compliance manuals.
- Submit and Pay Fees: File the application online via the FSCA FAIS eLicensing System and pay the statutory application fee (ranging from roughly R2,697 upwards depending on the FSP license Category.
- Regulatory Review: Respond to any queries, feedback, clarifications, or request for information issued by the FSCA during the evaluation phase.
