How to Comply with National Credit Regulator (NCR) Regulations and Application Process in South Africa

How to Comply with National Credit Regulator (NCR) Regulations and Application Process in South Africa

To comply with National Credit Regulator (NCR) regulations in South Africa, you must register as a credit provider if your total loan book exceeds R500,000 or you have 100 or more active credit agreements.

The National Credit Regulator (NCR) regulates South Africa’s credit industry under the National Credit Act (NCA) to ensure fair lending and market compliance.

Who Needs to Register

  • Mandatory: Loan books over R500,000 or 100+ agreements.
  • Excluded: Loan books under R500,000 with fewer than 100 agreements.
  • Risk: Unregistered lending voids capital and interest recovery.

Step-by-Step Application Process

  1. Download Form(s): Obtain Form(s), including Form 2 Application from the NCR website.
  2. Setup Company: Register company as legal entity or operate in personal capacity.
  3. Gather Documents: Prepare CIPC papers, certified IDs, Passports, SARS/bank proofs, and police clearance certificates or criminal records.
  4. Pay Fees: Cover the R500 application fee plus initial category fees (R1,500 to R300,000 based on principal debt).
  5. Submit Pack: Lodge documents and proof of payment directly to the National Credit Regulator (NCR)

Ongoing Compliance Requirements

  • Register the entity as an accountable institution as required by the Financial Intelligence Centre (FIC) under the Financial Intelligence Centre Act (FICA).
  • Develop and implement risk management and compliance programmes (RCMP) under the FICA legislative frameworks.
  • Annual Returns: File statistical returns (Form 39/40) and compliance reports.
  • Financials: Submit annual financial statements within 6 months of the year-end.
  • Conduct: Adhere to maximum interest/fee caps and debt review guidelines.

Once registered there are many regulatory requirements which Credit Providers are required to meet which include those set out above and in the NCA and requirements imposed on them by the Financial Intelligence Centre Act (FICA). Credit Providers must report on their compliance with the various provisions to the NCR every year.
